The way I see it, since subclause 4(2) has been deleted and the pilot is not mentioned, the exporter is the only one who has an obligation: He must provide a written declaration that the horse is not being exported for slaughter or another document satisfactory to the minister.

Agriculture committee  Further to the amendments put forward by Mr. Louis, subclause 4(1) reads as follows: 4 (1) It is prohibited for a person to export a horse from Canada by air unless they have, in the form and manner specified by the Minister, provided the Minister with a written declaration attesting that, to the best of their knowledge, the horse is not being exported for the purpose of being slaughtered or fattened for slaughter as well as with any other documentation that the Minister may require.
